Terms of Service

These terms apply to any research, comparison, shortlist or support work we carry out for you. By instructing us, you agree to them. Please read them before you proceed.

1. Scope of services

We provide buyer-side property research and matching services. Depending on what you instruct us to do, this may include preparing a written buyer requirements brief, researching current property availability from public and published sources, checking local and public records, comparing options against your stated criteria, producing a shortlist document and providing general support while you work through your options.

Each instruction is scoped and priced in writing before work begins. Work outside that scope is not included and will be quoted separately.

2. Not a property agency and no representation

We are not a property agency, we do not act as an intermediary in any transaction, and we do not represent you or anyone else in the purchase or sale of a property. We do not market, list, advertise or offer properties for sale. We do not act on behalf of any seller, we do not conduct viewings on a seller’s behalf, and we are not a party to any agreement you enter into.

We do not negotiate, bid, submit offers or otherwise transact on your behalf. Any negotiation, offer, contract or conveyance is a matter between you, the seller’s representatives and your own legal advisers. Nothing we provide should be relied on as legal, tax, financial or property advice.

3. Not investment or valuation advice

Nothing in our research, comparison or shortlist constitutes investment advice, a valuation, an appraisal of value, a survey or a professional opinion on the condition, suitability or prospects of any property. Any figures we report, including asking prices and recorded sale prices, are factual information taken from the sources identified and may change without notice.

You are responsible for obtaining a survey, a valuation, legal advice and any other professional input you consider necessary before committing to a purchase.

4. Fees and refunds

Fees are fixed, quoted in pounds sterling and confirmed in writing before work begins. Fees are payable in advance. Current fees are £45 for a buyer requirement profile, £120 for a research and comparison round, £195 for a complete buyer match and £65 for an additional search round.

There is no commission and no fee is payable by reference to the price of any property or on completion of any purchase. If you cancel before work has begun, any fee already paid is refunded in full. Once work has begun, the fee for that piece of work is not refundable, because the work cannot be returned. Where we have not been able to carry out the work you instructed us to do, we will refund the fee for that work in full.

5. What we cannot promise

We do not and cannot promise that a search will identify a property you wish to buy, that any property will remain available, that a transaction will complete, or that any particular outcome will be achieved. Property markets change constantly and the availability, prices and details of properties are outside our control. Our commitment is to carry out the work you instruct us to carry out, to the standard described, and to report accurately what we find, including when we find very little.

6. Accuracy and your responsibility

Our research relies on third-party sources including property advertising, Land Registry data, planning portals and published local information. We record our sources so that you can verify them. We do not verify a seller’s description of a property, we do not inspect properties, and we do not confirm title, lease terms, structural condition or compliance matters. You must satisfy yourself on all such matters through your own inspections, searches and professional advisers before committing to a purchase.

7. Limitation of liability

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

Subject to that, our total liability to you in connection with any instruction is limited to the total fees you have paid us for that instruction. We are not liable for indirect or consequential losses, loss of profit or opportunity, or for decisions you take on the basis of information we provide. We are not responsible for the acts or omissions of sellers, their representatives, surveyors, lenders, solicitors or any other third party.

8. Confidentiality and data

We keep your requirements and personal information confidential and handle them as set out in our privacy policy. We do not share them with sellers, developers or third-party introducers, and we do not accept payments for passing them on.

9. Intellectual property

The documents we prepare for you are provided for your personal use in connection with your own property search. You may share them with your family and professional advisers. They may not be reproduced, published or supplied to any third party for commercial purposes.

10. Complaints

If something has not met your expectations, please tell us first at info@empire-property.support. We will acknowledge your complaint within five working days and aim to resolve it within twenty-eight days.

11. Governing law

These terms and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any part of these terms is found to be unenforceable, the rest remain in force.
